House Committee on Oversight and Government Reform Chairman James Comer expressed his support for H.R. 2096, known as the Protecting Our Nation’s Capital Emergency Act, during a speech on the House floor. The bill, introduced by Representative Andrew Garbarino, aims to restore due process protections for Washington, D.C. police officers.
Comer began his remarks by acknowledging the service of the D.C. Metropolitan Police Department in maintaining safety in the District. He referenced the Comprehensive Policing and Justice Reform Amendment Act of 2022 passed by the D.C. Council on January 4, 2023, which he stated had removed certain employee protections from police officers amidst rising crime rates.
Congress initially attempted to overturn this legislation through H.J.Res. 42, which received bipartisan support but was vetoed by then-President Biden. In response, Rep. Garbarino reintroduced legislation to repeal specific provisions of the Act.
According to Comer, “H.R. 2096 restores D.C. police officers’ right to collectively bargain over disciplinary matters and reinstates clear timelines for disciplinary investigations.” Additionally, it removes a requirement from the D.C. Council that mandates public posting of adverse action hearings’ details, which Comer claims could lead to harassment of officers.
He concluded by emphasizing that supporting law enforcement is crucial for addressing crime in Washington D.C., stating that “by restoring employee protections, this legislation gives the Metropolitan Police Department officers the due process they need to confidently do their jobs.”
