Comer requests interview with APHIS official over Horse Protection Act concerns

Congressman James Comer is intensifying oversight of the U.S. Department of Agriculture's (USDA) enforcement of the Horse Protection Act (HPA). The concern arises from USDA’s Animal and Plant Health Inspection Service (APHIS) potentially exceeding its authority in horse show inspections. Comer has requested a transcribed interview with Dr. Aaron Rhyner, Assistant Director of APHIS, to address these issues.

"The Committee on Oversight and Accountability is continuing to conduct oversight of the U.S. Department of Agriculture’s (USDA) enforcement of the Horse Protection Act (HPA) and its promulgation of a final rule titled Horse Protection Amendments that will update USDA’s standards regarding the HPA," wrote Chairman James Comer. He added that this step was taken due to concerns about USDA's compliance with the HPA following actions at Tennessee Walking Horse shows.

The Committee received reports alleging that Dr. Rhyner sent an email to horse show representatives about new inspection requirements shortly before a competition, without prior notice. On August 9, 2024, Comer urged the Office of Inspector General to review USDA's policies concerning HPA implementation. The Committee also sought documents for oversight purposes but has only received limited information from USDA so far.

"It is imperative that USDA enforces HPA in a manner that is fair, consistent, and within the bounds of its statutory authority," stated Chairman Comer. He emphasized concerns over allegations of arbitrary enforcement and lack of due process against horse trainers and owners. Comer stressed the importance of hearing directly from Dr. Rhyner to understand USDA’s approach to enforcing the HPA.
